Trans people are not women. A sentence, the one issued in the United Kingdom a month ago, which made a lot of noise. It took 88 pages rumped by the Supreme Court to define that whoever was born a woman remains a woman, to certify that the baby girl who has just left the maternal uterus during childbirth, after the gaze of the gynecologist on the genitals, is recorded of women’s biological sex, a defined and definitive condition, without being changed in any way in the future. And in fact for centuries, and since there is the registry, the sex of a newborn has been recorded by medical and obstetric staff based on the simple observation of the external genitals.

For science, however, biological sex, in addition to being determined and certified by eye, on the basis of external somatic characters, is above all that inscribed in the chromosomal heritage, an innate and unchangeable figure of sexual identity, especially an incontrovertible fact from a genetic and scientific point of view.

Except for some cells (sperm, oocytes and red blood cells) each other single cells of our body contains 23 couples of chromosomes, for a total of 46, plus a pair of fundamental chromosomes to determine the development of sexual characteristics, which are different in the two genres, since the females have two equal (XX), one inherited from the father and the other by the mother, while the male chromosomes are always two but (XY), the X chromosome inherited from the mother and the Y by the father.

The sentence of the United Kingdom in practice has established that the term “woman” must be referred exclusively to a person born biologically female sex (XX), effectively excluding all those people from this denomination who, despite being born men (xy), define themselves as “transgender women”, even if in possession of a certificate of gender recognition (GRC). In London the sentence, which made science prevail over ideology, was accepted as an epochal decision, which erases years of conditioning imposed by the LGBT movement, and the document adds that a transgender person has every right to say and do what he wants of his own body, but whoever is born a woman remains a woman, and whoever was born man remains man, for a lifetime.

In addition to ideology, there is a great scientific ignorance on the notions of sex and gender, today at the origin of violent debates of opinion, two distinct things, to the point that the idea has spread that changing genre is equivalent to changing sex, but the “gender” is a socio -cultural notion, that is, linked to environmental and cultural factors, while the “sex” is a biological notion that is impressed in the DNA of its genetic heritage, which is innate and immutable.

You can therefore certainly change gender when you want, with hormones or surgery, but you cannot absolutely change biological sex by ignoring the effect of the genes of sex chromosomes, which will continue to work undisturbed within each organ, continuing genetically to emphasize the differences between men and women, those that cannot be reversed or destroyed with any medical or surgical therapy. From the moment, however, that the “change” of sex falls within the untouchable riverbed of the self-determination of the person and concerns his very personal rights, the state cannot force anyone, in no way, to certain clinical-medical paths to obtain it and modify it physically.

The Constitutional Court, in fact, with the sentence n.221 of 21 October 2015, indicates that the condition for “changing sex”, for the purposes of the personal rectification path, leads to excluding the obligation of surgery to carry out the adaptation of the sexual characteristics, and puts back to the individual the choice of the methods through which to carry out his transition path, so today if a Mario wants to become Maria, he can do it even with hormonal therapy (for the growth of the breast, hair and beard, the softness of the skin, the modulation of the voice or the enlargement of the pelvis etc.), but sooner or later a judge of the Cassation or the Consulta will arrive who will affirm that the desired sexual characteristics may have nature even psychological and not necessarily physiological, so that Mario who feels Mary, despite being biologically a man, will have already changed the perception and conviction from the point of view, Which is enough to change the name to the registry, and he will obtain everything without any hormonal or surgical therapy, but simply with self -certification.

This is what has already happened, for the first time in Italy, a unique case, with a sentence of the Trapani court that gave the green light to the change of name and gender identity, without any therapeutic intervention, to a 53 -year -old transgender person, who from Emanuele became Emanuela, while keeping his male sexual organ intact. This sentence will certainly open new scenarios, could lead to re -evaluate many scientific certainties recognized for centuries, since, if it is legally legitimate to change sex to the registry when you want, the genetic data imprinted in the chromosomes would become irrelevant, as well as the physical one.

The term transgender includes all those people passing from one genre to another with respect to the sex of birth, that is, consider themselves belonging to the opposite sex, are perceived with a different identity, or cannot identify themselves in the classic “male” or “female” binarism, such as the new figure created, that “queer” that goes beyond the two sexes and genre roles which, for example, attract the use of the nail polish only women.

According to the estimate of WHO in the world there are about 25 million transsexual people (0.3/0.4% of the world population) while in Italy the data of the Higher Institute of Healthcare have about 400 thousand transsexuals, but every year less than 50 operations for the gearbox from men’s sex to female or vice versa are carried out, due to the long, complicated and tiring surgical path necessary, and the impacting effect from a personal and emotional point of view, above all. Because irreversible.
